Under the Qui Tam Provisions of the False Claims Act

These statutes generally allow the government to recover three times actual damages in addition to civil penalties for each invoice or false statement used to secure payment from the government.

Whistleblowers who initiate false claims cases are entitled to a portion of the money, or a bounty, generally ranging from 15 to 30 percent of the government’s total recovery. Since 1986, False Claims Act qui tam whistleblowers have been paid more than $2 billion in bounties.

False Claims Act Qui Tam Litigation

The False Claims Act can be enforced by private citizens, or whistleblowers, using the qui tam provisions of the act. Qui tam is a Latin phrase meaning, “he who sues on behalf of the king.”  A company or person may be legally liable for filing a false claim for payment or by simply causing another company or person to file a false claim for payment. Whistleblowers are similar to plaintiffs in other civil lawsuits, but are referred to as relators in legal terms.
