Overview

Kyle McGee represents sovereigns and other public entities in high-stakes environmental, consumer protection, and whistleblower matters.

Whether a manufacturer operating thousands of miles away is causing general harm to natural resources due to the widespread use of its dangerously defective products, or a facility’s release or emission of harmful substances into specific communities is endangering public health, state and local government entities turn to Kyle for redress, starting with compensation they can use to reverse and remediate the damage.

Partnering with state Attorneys General and municipalities, Kyle regularly pursues actions against corporate defendants engaged in environmentally destructive conduct or unfair or deceptive trade practices that undermine the public’s trust in the marketplace. These cases often involve products widely purchased by governments and their residents, resulting in far-reaching, and initially hidden, consequences. Kyle also represents states and cities in matters involving overcharging or deception in contracts funded by public dollars, particularly where vendors supply essential services (e.g., healthcare services and administrative services) tainted by fraud.

Confidential qui tam whistleblower actions under the federal and various state False Claims Acts is another key area of Kyle’s practice. He represents relators pursuing fraud and misconduct across a wide range of industries, including medical and mental healthcare, residential mortgage lending, defense contracting, retail and finance. His experience also extends to whistleblower claims filed under the SEC and CFTC whistleblower programs.

When I’m not focusing on the environment professionally, I enjoy doing so personally— in part by staying on top of new scientific developments and reading books about environmental history, theory, and policy. It is admittedly not always the lightest literary fare, but I have a genuine passion for the topic that feeds back into my practice every day in a tangible way.
