As my track record shows, I tend to gravitate towards the challenging cases, often in jurisdictions where people tell me I can’t win. But, what drives me is the challenge and the satisfaction of righting a wrong.
Overview
With more than two decades of experience litigating across the country, Jerry represents children with preventable brain injuries and other trauma caused by negligent obstetric care.
Jerry’s work has led to several record-breaking verdicts and settlements in historically tough jurisdictions. He recently secured a $6 million verdict, purely non-economic damages, in a wrongful death case, after convincing a South Carolina jury that the medical professionals involved were grossly negligent, a standard rarely met in this extremely conservative jurisdiction. He also won an $8.4 million verdict for a child, brain damaged by a birth injury, against a hospital that had never lost a case. The hospital was so confident, in fact, that it did not engage in settlement discussions. (He received The Daily Report’s Verdicts Hall of Fame award for this verdict.)
Jerry continues to be driven by the same work ethic and drive that led him to excel at The Citadel. He thrills at tackling challenges others see as too hard or even impossible, and prides himself on learning the facts and the medicine involved in each case better than anyone else – so well that he can transform complex medical jargon and facts into a compelling story, told in ordinary language for the jury.
Before joining Grant & Eisenhofer, Jerry was a partner at a national law firm, where he served as lead and co-counsel in high stakes litigation (primarily also in birth trauma and medical malpractice cases) in multiple state and federal jurisdictions.
Experience
Obtained a $15.1 million judgment for a child with cerebral palsy caused by sub-standard obstetric care provided to his mother at a military hospital in Clarksville, Tennessee.
Obtained what is believed to be the first verdict for a patient in a case involving the laser extraction of pacemaker/defibrillator lead wires. This case was tried in Spartanburg, South Carolina on behalf of the children of a patient who died because the personnel and equipment needed to respond to a foreseeable complication were not readily available.
Obtained a substantial verdict against a hospital in York County, South Carolina on behalf of the parents of a child who died after living for four years with a brain injury caused by negligent obstetric care.
Led the discovery efforts relating to the Pfizer drug Provera in MDL 1507, In re Prempro Products Liability Litigation. This consolidated litigation involved the claims of more than 12,000 women who developed breast cancer following the use of hormone therapy drugs. Over the course of three years he coordinated the document review, the assembly of exhibits, the development of expert witnesses, and personally took the depositions of pharmaceutical executives and scientists involved in the development and marketing of Provera. His work contributed to successful verdicts and settlements in cases tried across the country.
Lead counsel for the State of South Carolina against Cephalon, Inc. After nearly four years of litigation this case ended with a favorable settlement for the State.
